Agreement to Terms

Welcome to AIParksit. These Terms of Service ("Terms") govern your access to and use of our parking platform, website, mobile applications, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

AIParksit ("we," "us," or "our") operates as a platform connecting drivers seeking parking with space owners and operators. We are not a parking operator and do not own or control parking spaces listed on the platform.

Eligibility and Account Registration

Eligibility

You must be at least 18 years old to use the Service. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

Account Creation

To access certain features, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your account information
• Keep your password secure and confidential
• Notify us immediately of any unauthorized access
• Accept responsibility for all activities under your account

You may not create multiple accounts, use another person's account, or transfer your account without our written permission.

Booking and Payment Terms

For Drivers

• Booking: When you reserve a parking space, you enter into a binding agreement with the space owner/operator
• Payment Authorization: Your payment method is authorized at the time of booking, but funds are held in escrow
• Payment Capture: Payment is captured only after you confirm parking or after the grace period expires
• Cancellations: Free cancellation within 5 minutes of booking. Late cancellations may incur fees
• No-Shows: Failure to use a confirmed reservation may result in full charge and account restrictions
• Pricing: Prices are set by space owners and may vary based on demand, time, and location

For Space Owners and Operators

• Revenue Share: We charge a platform fee (20% for standard listings, 15% for premium operators)
• Payouts: Funds are released 24 hours after parking confirmation
• Pricing Control: You set your own rates, but we may suggest optimal pricing via AI
• Availability: You must accurately represent space availability and specifications
• Taxes: You are responsible for all applicable taxes on your earnings

Payment Processing

Payments are processed by third-party providers (Stripe, PayPal). We do not store full credit card information. You agree to comply with their terms of service.

Prohibited Conduct

You agree not to:

• Use the Service for any illegal purpose or violate any laws
• Provide false, inaccurate, or misleading information
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to systems or accounts
• Use automated tools (bots, scrapers) without permission
• List spaces you do not own or have authority to rent
• Engage in fraudulent transactions or chargebacks
• Discriminate against users based on protected characteristics
• Harass, abuse, or harm other users
• Circumvent platform fees by completing transactions off-platform

Liability and Disclaimers

Platform Role

AIParksit is a platform that connects users. We do not:

• Own, operate, or control parking spaces
• Employ space owners or operators
• Guarantee the accuracy of listings
• Guarantee space availability or quality
• Assume liability for damage to vehicles or property
• Mediate disputes between drivers and owners (though we may assist)

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AIPARKSIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY SHALL NOT EXCEED THE FEES YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless AIParksit and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the Service, violation of these Terms, or infringement of any rights of another.

Intellectual Property

The Service, including all content, features, and functionality, is owned by AIParksit and protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Reverse engineer or decompile our software
• Create derivative works based on the Service

You retain ownership of content you submit, but grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute it in connection with the Service.

Privacy and Data

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to our collection, use, and sharing of information as described in the Privacy Policy.

Termination

We may suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Excessive chargebacks or payment disputes
• Abuse of the Service or other users
• Any reason at our sole discretion

You may close your account at any time by contacting support. Upon termination, your right to use the Service immediately ceases. Sections that by nature should survive (payment obligations, indemnification, limitation of liability) will remain in effect.

Dispute Resolution

Informal Resolution

If you have a dispute with us, please contact support@aiparksit.com first. We will attempt to resolve disputes informally within 30 days.

Arbitration

If informal resolution fails, disputes will be resolved through binding arbitration rather than in court. You agree to waive your right to a jury trial and to participate in class action lawsuits.

Governing Law

These Terms are governed by the laws of [Your Jurisdiction], without regard to conflict of law principles.

Changes to Terms

We may modify these Terms at any time. We will notify you of material changes by email or through the Service. Your continued use after changes constitutes acceptance of the modified Terms. If you do not agree to changes, you must stop using the Service.

Miscellaneous

• Entire Agreement: These Terms constitute the entire agreement between you and AIParksit
• Severability: If any provision is found invalid, the remaining provisions remain in effect
• Waiver: Our failure to enforce any right does not constitute a waiver of that right
• Assignment: You may not assign these Terms without our consent. We may assign them freely
• Force Majeure: We are not liable for delays or failures due to events beyond our control
